Old Monk maker withdraws plea against ban

Agrees to submit revised labels to FSSAI

Old Monk’s maker, Mohan Rocky Springwater Breweries, has pulled back its challenge to the food safety regulator’s sales restriction.

According to Bar and Bench and other media reports, the Maharashtra-based company withdrew its petition from the Bombay High Court and will instead follow the regulator’s standards and submit revised labels to the Food Safety and Standards Authority of India (FSSAI).

The FSSAI had earlier stopped sales of certain Old Monk variants, including Legend, Gold Reserve and XXX Matured Rum, along with some other liquor brands. It said their packaging and labelling did not meet requirements.

One objection was to the word ‘Rum.’ The regulator argued that the product is made from neutral spirits with artificial or nature-identical flavorings, not through natural fermentation and maturation, so it should be labeled ‘Flavoured Rum.’

It also objected to the ‘7 years old blended’ claim. Under FSSAI guidelines, the age stated for a blend must be that of its youngest spirit, not its oldest, so that consumers are not misled.

The withdrawal comes after the High Court declined to grant the company interim relief at a hearing in August. With the restrictions in Maharashtra set to stay in force through a long trial, the company decided to drop the case.
