While issuing notice, the court observed that “this issue concerns us all,” underscoring the wider public health significance of the matter.

The petition is founded upon scientific evaluations and risk assessments published by internationally recognized public health and food safety bodies, including the International Agency for Research on Cancer (IARC), the joint FAO/WHO Expert Committee on Food Additives (JECFA), and the World Health Organization (WHO). 

These assessments have drawn global attention to the potential long-term health implications associated with the consumption of certain artificial sweeteners, including concerns relating to possible carcinogenicity, metabolic disorders, neurological effects, cardiovascular disease, and alterations to the gut microbiome. 

Through the petition, the Indian Sugar & Bio-energy Manufacturers Association (ISMA) has sought judicial intervention to strengthen the regulatory framework governing artificial sweeteners in India. The reliefs sought include directions for independent India-specific scientific studies, enhanced consumer awareness, and transparent warning disclosures to enable consumers to make informed dietary choices.

The matter was led by senior advocates Rajshekhar Rao and Ankur Chhibber, instructed by AKS Partners.
